HIPAA notice of Privacy Practices


Notice of Privacy Practices: This document explains how Miami Sonogram, as a healthcare provider, handles protected health information (PHI) and complies with the Health Insurance Portability and Accountability Act (HIPAA).

NOTICE OF PRIVACY PRACTICES. Miami Sonogram LLC. Effective Date: May 2022.

We are required by law to maintain the privacy of your protected health information (PHI) and to provide you with this Notice of our legal duties and privacy practices with respect to your PHI. We must follow the privacy practices that are described in this Notice while it is in effect. This Notice takes effect on May / 01 / 2022 and will remain in effect until we replace it.

We reserve the right to change our practices and to make the new provisions effective for all PHI that we maintain. Before we make a significant change in our practices, we will change this Notice and post the new Notice on our website. You may also obtain a copy of the new Notice by contacting us at the address or telephone number listed at the end of this Notice.

OUR LEGAL DUTIES

We are required by law to:

-Make sure that your PHI is kept private.

-Give you this Notice of our legal duties and privacy practices with respect to your PHI.

-Follow the terms of the Notice that is currently in effect

HOW WE MAY USE AND DISCLOSE YOUR PHI

We may use and disclose your PHI for the following purposes:

-Treatment: We may use and disclose your PHI to provide, coordinate, or manage your healthcare and any related services. This may include sharing your PHI with other healthcare providers who are treating you.

-Payment: We may use and disclose your PHI to bill and collect payment for the healthcare services and items you receive from us.

-Healthcare Operations: We may use and disclose your PHI as necessary for our healthcare operations. This may include quality assessment and improvement activities, reviewing the competence or qualifications of healthcare professionals, and conducting training programs.

-Required By Law: We may use and disclose your PHI when required to do so by federal, state, or local law.

-Public Health: We may disclose your PHI to public health authorities for purposes such as preventing or controlling disease, injury, or disability.

-Health Oversight: We may disclose your PHI to a health oversight agency for activities authorized by law. These activities may include audits, investigations, inspections, and licensure.

-Legal Proceedings: We may disclose your PHI in the course of any judicial or administrative proceeding, in response to a subpoena or other legal process, or as otherwise required by law.

-Law Enforcement: We may disclose your PHI to law enforcement officials for purposes such as reporting crimes, identifying or locating suspects, witnesses, or missing persons, or responding to court orders or subpoenas.

-Coroners, Medical Examiners, and Funeral Directors: We may disclose your PHI to a coroner or medical examiner for purposes such as identifying a deceased person or determining the cause of death. We may also disclose your PHI to funeral directors as necessary to carry out their duties.

-Research: Under certain circumstances, we may use and disclose your PHI for research purposes. We will only do so if the research has been approved by an institutional review board (IRB) or a privacy board that has reviewed the research proposal and established protocols to ensure the privacy of your PHI.
